1. About these terms
These Website Terms of Use govern your use of secure-form.com, fieldstone-health.com and the other websites run by Fieldstone Health, LLC, a Massachusetts limited liability company located at 14 Algonquian Drive, Natick, MA ("Fieldstone," "we" or "us") (together, the "Sites"). By using the Sites, you agree to these terms. If you use the Sites for an organization, you agree to them for that organization too.
- Customers. If your organization has signed our Services Agreement and Business Associate Agreement, those agreements govern our services and prevail over these terms. If you fill in a form that one of our customers asked you to complete, that form is governed by our agreement with that organization and by its own privacy notice, not by these terms, apart from sections 2 and 3.
- Free demos are also governed by our Free Demo Terms.
- Privacy. Our Privacy Policy explains what information we collect and how we use it.
2. Using the Sites
You may use the Sites to learn about our services, contact us, request a free form and try our demos. You may not:
- use the Sites unlawfully, or to send unlawful, infringing or malicious content;
- try to gain unauthorized access to the Sites, our systems or other people's information, or interfere with their security or operation;
- copy, scrape or harvest content or data from the Sites by automated means, except as search engines normally do;
- pretend to be someone else or misrepresent your organization; or
- use the Sites to build a competing product.
3. Not medical advice, not for emergencies
The Sites provide information about software. Nothing on them is medical, legal or compliance advice. The Sites and the forms we host are not for emergencies. In a medical emergency, call 911 or your local emergency number.
4. What you send us
Blank templates only. Please submit only blank templates through our business contact and upload channels, without patient information. For patient matters, contact your healthcare organization instead.
Your permission. When you send us a template, form, logo or other material, you confirm you have the right to send it, and you let us use it to answer your request and build your form or demo. You keep ownership of what you send.
Patient information sent by mistake. If we receive patient information through these channels, we restrict access to it, assess what happened, and arrange secure return or deletion, as section 3 of our Privacy Policy describes.
5. Free demos
Demo forms are for fictional patient information and blank templates only, and are governed by our Free Demo Terms. Using any form with real patients requires a signed Services Agreement, Business Associate Agreement and service schedule, and our activation of the service.
6. Our content
We own the Sites and their content, including text, designs, code and logos, apart from material others send us. You may view, print and share pages from the Sites to evaluate our services for yourself or your organization. You may not otherwise copy, change or reuse them without our written permission. Fieldstone Health and Secure Form are our names and marks.
7. Disclaimers
The Sites are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties about the Sites, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Sites will always be available or free of errors.
8. Limits on our liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Sites or a free demo, and our total liability to you for that use is limited to $100. This section does not apply to a signed Services Agreement or Business Associate Agreement, which have their own terms, or to liability the law doesn't allow us to limit.
9. Changes to these terms
We may update these terms by posting a new version here with a new effective date. A change applies from that date, and not to disputes that arose earlier.
10. Governing law and venue
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Subject to applicable nonwaivable law, any dispute about them must be brought in the state courts located in Middlesex County, Massachusetts or the United States District Court for the District of Massachusetts.
